We certainly understand your concerns about how much it costs to file bankruptcy. Unfortunately, due to the many changes in the bankruptcy law that occurred in 2005, the cost of filing for bankruptcy has increased. We strive to keep our fees reasonable without it affecting our customer service.  Even though many lawyers in south central PA are charging well over $1500 for a Chapter 7 banrkuptcy, our flat fee is under that amount.

The first appointment, called the "pre-bankruptcy screening", costs $295, and full credit is given towards the final bankruptcy fee, outlined below.  This appointment is generally done via a web conference with Attorney Cutaia and lasts approximately 2 hours.

Chapter 7:

$1,395 for an individual or joint Chapter 7 bankruptcy.   The $295 pre-bankruptcy screening fee is PART of the $1395.  This does not include the filing fee of $338, which you can pay in three monthly installments after your bankruptcy has been filed.

Chapter 13: 

$1,395 for an individual or Chapter 13 bankruptcy is due up front, with the balance paid through the Plan. The $295 pre-bankruptcy screening fee is PART of the $1395. This does not include the filing fee of $313, which you can pay in three monthly installments after your bankruptcy has been filed.  

Our Chapter 13 fee structure depends on whether you are making a payment to unsecured creditors or not. The initial non-refudable payment is $1,395.  The balance depends on whether you are making a payment to unsecured creditors. If you are making a payment to unsecured creditors, we can get paid OUT of those funds (meaning our fee comes out of money you are paying anyway in most cases). For clients who are NOT making a payment to unsecured creditors in their Chapter 13 bankruptcy (we will discuss this with you), we cap our attorney fees at $4,500 for all work done prior to the confirmation hearing (the $4,500 includes the $1395 you pay before your case is filed).  Costs are NOT part of the cap. After your plan is confirmed we will bill at our hourly rate for any work done, as outlined above.  Note that the vast majority of work on your case will be completed by Plan confirmation.  Work done after confirmation usually includes motions to amend a plan due to falling behind in your payments, or a change in circumstances.  Many clients go their entire case with zero additional attorney fees due after their Plan is confirmed.
